RELEASE OF LIABILITY AND HOLD HARMLESS AGREEMENT

             This Agreement, made as of this _______ day of _________________, 20___ between HHH Ranch and all trainers, teachers, employees, managers and members (hereinafter referred to collectively as “HHH Ranch”) and the person(s) executing this document (hereinafter referred to as “Client”).

                 In consideration for HHH Ranch’s services, Client voluntarily agrees to the terms of this RELEASE OF LIABILITY AND HOLD HARMLESS AGREEMENT and hereby agrees to personally assume the risks associated with HHH Ranch’s horse riding, training, teaching, boarding services and dog sledding as set forth below. 

                 Client hereby releases, waives, and forever discharges HHH Ranch of all actions of whatever kind or nature either in law or in equity arising from or by reason of any bodily injury or personal injuries known or unknown, death, or property damage - including damage to Client’s horse, dog and/or other personal property –  resulting during Client’s presence on HHH Ranch premises and any activity involving HHH Ranch’s services so long as such injury, property damage, or death is not caused by an intentional, willful, or wanton act or omission of HHH Ranch (i.e. Client releases HHH Ranch from liability for damages caused by HHH Ranch’s negligence only).  Client assumes full responsibility for the risk of bodily injury, death, or property damage from such activities, and shall hold HHH Ranch harmless for any liability thereof as set forth herein.

                 Client further agrees that if a claim or lawsuit is made against HHH Ranch, its owners, shareholders, agents, and/or employees for any injury or damage brought by, or allegedly attributable to, Client arising from Client’s presence on HHH Ranch’s premises or any activity involving HHH Ranch’s services, Client will pay all attorney's fees and costs reasonably incurred by HHH Ranch to defend that claim or lawsuit and will reimburse HHH Ranch for any judgment, expense, or other damage incurred.   

                 This release is given on behalf of Client, Client’s spouse, Client’s legal representatives, administrators, executors, heirs, and assigns, and in the case of any child or children of Client’s, on behalf of them, their legal representatives, administrators, executors, heirs and assigns.  This release is an ongoing release and remains in effect until Client has revoked it in writing.

CLIENT ACKNOWLEDGES AND AFFIRMS THAT HE/SHE HAS CAREFULLY READ THE CONTENTS OF THIS DOCUMENT, UNDERSTANDS ITS MEANING, AND HAS VOLUNTARILY EXECUTED THE SAME.
